Terms of Service:
Commissioned Artwork
If you commission me you agree to these terms, including future editions.
-
These products are purely digital. There is no physical shipment or product.
-
I have the right to post an display the artwork I make and any part of its process, including on social media, portfolios, examples of future commissions, or videos such as timelapses. These may have monetized ads enabled and be used to promote my art.
-
You do not have any rights to the commissioned work unless it is paid for in full. This means that, unless paid for, you may not reuse, redistribute or adapt/edit the commissioned work in any way. Cancelling/withdrawing payment means you forfeit all rights to it.
-
If you avoid/refuse payment/contact or withdraw payment, I may use non-copyrighted aspects for other means. I obviously won't attempt to resell your material (such as character or species designs) but may take vague details (such as generic backgrounds or lineart) for other uses. Please inform me of any issues that may prevent you from paying quickly and I will be happy to help compromise, but if you simply never pay without explanation then I will salvage what I can from the effort I spent on your commission.
-
If paid for in full, you have the right to repost, redistribute and edit the commissioned artwork (as long as you cite Soulsplosion/myself in some way)
Using Commissioned Art for Profit
"For Profit" refers to any type of gain for yourself or your associates, including money, as well as digital currency or trade for some other service or item.
You may redistribute or use art that you commissioned for profit only in the following scenarios:
-
Coloring and selling designs made using lineart that was commissioned for such purpose
-
Re-selling a character you commissioned from me, or selling a character that has art commissioned from me included
-
Any other purpose that you have acquired permission for, and this permission is explicitly stated by me in the TOS of the paypal invoice used for the payment of the commission.
Scenarios in which you may NOT redistribute my art for profit (if you haven't acquired explicit permission) include but are not limited to:
-
Selling prints or versions simply in other mediums such as on coffee mugs or shirts
-
Using my art to decorate or promote a site or something similar which you use for profit
-
As an illustration inside or on the cover of a book
Refunds
You are only eligible for a refund BEFORE I move on from the concept-sketch stage. Once a concept sketch is agreed on, and I start official work on the commission, it is non-refundable.
I will refund the entire payment if possible but some online forms of payment have taxes that may affect it.
Refunds acquired not through my agreement (such as a claim on PayPal) will result in you forfeiting any and all rights to the commissioned work.
